Most common programs

SSD

When you apply for SSD benefits, the government goes into a lengthy and complicated five-step process to decide your eligibility. This process includes evaluating your age, education, work history, skill levels, and your physical and medical condition to determine whether you qualify. In addition, Social Security has its own definition for what it means to be disabled, and it is very strict. Some facets of the definition include:

  • You must either be permanently disabled from working, or your earning capacity has been significantly and permanently diminished
  • You must demonstrate through medical certification either that your injury is permanent or that it is likely to last for at least a year or result in death
  • You must have a qualifying history of earnings that includes how many years you have worked over your lifetime and also if you have worked in five of the past ten years and accumulated the required number of work credits during that period

Disability determination

In its initial assessment, the Social Security Administration will try to determine if your disability prevents you from performing “substantial” work in any occupation for at least 12 months. Your disability will be compared with a list of impairments the SSA feels are sufficiently severe to qualify immediately as disabled.

If your disability is not on the list, or determined not to be of equal severity to a condition on the list, the SSA will then determine if your condition interferes with your ability to do any type of work, taking into consideration your age, education, and past work experience.

If the SSA denies your claim, it is important to call us right away. If you do not appeal the denial within 60 days, you may have to start over with a new application.
